Csihás polgármester Johanna /: Hanni :/ Stein’sche Heirats Ausstattungs Stiftungs Urkunde Heirats-Ausstattungs-Stiftungs Urkunde Der Wille Gottes des allmächtigen war es, die Gattin, resp: Mütter der gefertigten, Johanna /: Hanni :/ Stein geboren Deutsch, zu unserem grüßten Schmerze, viel früher als es nach dem Gesetzt der Natur zu geschehen pflegt, in ein besseres Jenseits abzuberufen. Der schmerzlich traurig unersetzlich Verlust berühet nicht blos unsere Familien allein, die wir in ihr die beste Gattin und Mütter beweinen, sondern auch die Armen in Zombor, denen sie ihr trauriges Loos Stats nach besten Dräften zu lindern bemüht war, verloren ihr eine wahre Wohlthäterin, deren es ein zu viele geben kann. Um das andenken der seeligen frau Johanna /: Hanni :/ Stein geboren Deutsch auch fernerhin zu erhalten, um die Erinnerung an diese fromme Wohlthäterin durch ein milde Stiftung bei künftigen Generationen zu verewigen, um endlich unserem Schmerze über ihr hinscheiden durch eine milde That einigermaßen Linderung zu verschaften, haben die gefertigten beschlossen eine Stiftung unter nachfolgenden bedingungen für ewige Zeiten zu gründen. I Name der Stiftung Die Stiftung führt den Namen „Johanna /: Hanni :/ Stein’sche Heirats-Asstattungs-Stiftungs.“ II Fond der Stiftung Als Fond, dessen jährliches Erträgniß für ewige Zeiten, unter den nachfolgenden Bestimmungen zu den unten bezeichenten Zwecke verwendet werden soll, wideren den gefertigten 2 /: zwei :/ Stück Actien der Zombor-Sparcassa-Actien-Gesellschaft No. 391 und 392 im Nominalwerthe am je 200 fl. sage zwei hundert Gulden in österr. Währg. III Zweck der Stiftung a) Diese Stiftung geschieht mit der ausdrücklichen und unabänderlichen Widmung, das aus dem Erträgniße der in Punkta II beschriebenen 2 Stück Zombor-Sparcassa-Actien jedesmahl 200 tage Zwei Hundert Gulden in österr. Währg. an Heirats-Ausstatungs-Beihilfe an hilfsbedürftige, moralisch gut gesittete in Zombor wohnhafte Mädchen mosaischen Confession in baarem Gelde, unter folgenden Bedingungen ausgefolgt werden. b) An eine Braut, welche die sub litt. zur Erlangung einer Heirats-Ausstattungs-Beihilfe vergeschriebenen Bedingungen nachgewiesen hat, können und dürfen ein mehr aber auch nicht weniger als 200 mit Worten Zwei Hundert Gulden in österr. Währg. – als Heirats-Ausstattungs-Beihilfe ausgefolgt werden. c) Sollte den jährliche Ertrag der genannten zwei Stük Actien weniger als 200 fl. ausmachen, so ist dieser Ertrag sammt den jeweiligen den der Zomborer-Sparcass zu gewährenden Ziesen und Zinseszinsen insolangen fructificirend anzulegen und zu vermehren, bis er die im Sinne dieser Stiftung zu einer Heirats-Ausstattungs-Beihilfe nötige höhe von Twei Hundert Gulden österr. Währg. erreicht hat. d) Beträgt hingegen der jährlich Ertrag den im Punkte II beschriebenen Actien mehr als 200 Gulden, so können auch so viele Heirats-Ausstattungs-Bewerberinen welche laut den im Punkte III litt a) enthaltenen Vorschritten einen Auspruch auf eine Ausstattungs-Beihilfe zu erheben berechtigt sind, - zu gleicher Zeit betheilt werden, - insolange das Erträgniß der Stiftung einen durch 200 fl. theilbaren Betraf ausweist, resp: insolange Beträge zu je 200 fl. verhanden sind. e) Die in litt. d) enthalten Bestimmung hat auch in dem Falle in Anwendung zu kommen, wenn bei Vorhandensein eines bereits vertheilbaren Betrages von wenigstens Zwei Hundert Gulden eine Bewerberin sich nicht melden sollen, oder eine solche nicht, welche den in dieser Stiftungs-Urkunde festgesetzten Bedingungen vollkommen entspricht, in welchem Falle gennanter jewiligen Ertrag fructificirend anzulegen ist, und vorkommenden Falles nach den sub litt. d) vorgeschrieben Bestimmungen auch an mehrer qualificirte Bewerberinnen vertheilt werden kann. f) Hat ein Bewerberin jene bedingungen nachgewiesen, welche im Sinne des Punktes III litt. a) zur erlangung der Heirats-Ausstattungs-Praemie vergeschrieben sind, so hat die Ausfolgung genannter Praemie von 200 fl. am Tage nach Rituell vollzogener Trauung erfolgen. IV Verwaltung des Fondes Die Verwaltung der dieser Stiftung gewidmete Sparcassa-Actien resp: der nach dieser und deren Coupons entfallenden Ziesen und Dividenden möge die Zomborer Sparcassa als Bewahrin dieser Actien, und der zu denselben gehörigen Coupons leiten und fruchtbringend anlegen, und sobald der Ertrag der Actien die höhe von Zwei Hundert Gulden oder einen durch Zwei Hundert Gulden theilbaren großeren Betrag erreicht haben wird, wollen die löbl. Direction der Zomborer Sparcassa-Actien-Gesselschaft dies nebst einen Bericht über den aus dem der Stiftung gewidmete Fonde sich ergebenen Ertrag, dem jewiligen Vorsteher der isr. Cultus-Gemeinde zu Zombor alsogleich anzeigen. V Art der Vertheilung des Erträgnisses Das Zuurtheilungsrecht, sowie das Recht der Anweisung der bereits verfügbaren Ausspattungs-beträge, an eine, - oder wenn in Sinne des Punktes III litt. d) mehrere Beträge zu je Zwei Hundert Gulden zur Vertheilung gelangene sollten – an mehrere gleichmäßig qualificirte Bewerberinnen, haben der jeweilige Bürgermeister der königl. Freistadt Zombor, der jeweilige Vorsteher der israel. Cultus-Gemeinde zu Zombor im Vereine mit dem ältesten großjährige männlichen Mitgliede der Familie nach Markus und Johanna /: Hanni :/ Stein auszuüben. Der gefertigte Markus Stein behält sich über die während seines Lebens zur Vertheilung gelangenden Ausspattungsbeträge, das Verfügungsrecht im Verein mit den abgenannten vor. VI a) Bei den diesfälligen Berathungenhat der jeweilige Bürgermeister der königl. Freistadt Zombor den Vorsitz zu führen. b) Sollte sich bezüglich der betheilung der Bewerberinnen, oder aus was immer für einem Grunde und anlasse zwischen den – im Sinne des Punktes V zur Anweisung resp. Ausfolgung des Ausspattungsbetrages – berechtigten Herren, eine Meinungsverschiedenheit ergeben, so entscheidet die Mehrheit der Stimmen. VII Nebenbestimmungen Falls die Zomborer-Sparcassa-Actien-Gesellschaft in der Zukunft neue Actien emittiren sollte, so behalten die gefertigten Gründen das Bezugsrecht, auf die etwa nach den Actien No. 391 und No. 392 entfallenden neuen Actien, ausdrücklich für sich und ihre gesetzlichen Erben bevor, so daß die eventuell zu begiehenden neuen Actien das ausschließlich Eigentum der Gründer resp: das ihrer Erben und Rechtsnachfolger bilden wird, in folge dessen auch die auf diese zu beistenden Einzahlungen ohne Belastung der Stiftung aus eigenem zu geschehen hat. VIII Die gefertigten Gründer behalten sich ferner und ihren Erben, das ihnen lauf Statuten der Zomborer-Sparcassa-Actien-Gesellschaft nach den dieser Stiftung gewidmete Actien zukommende Stimmrecht in der Generalversammlung mit dem Bemerken vor, daß dies auszuüben das älteste großjährige, männliche Mitglied der Familie nach Johanna /: Hanni :/ und Markus stein berechtigt ist. IX Im Falle die Zomborer-Sparcassa-Actien-Gesellschaft sich jemals auflösen sollte, so ist das zur Verwaltung dieser Stiftung bestellte Curatorium verpflichtet den erläs dieser Stiftungs-Actien in einem ähnlichen möglichst sichern Institite entweder in Actien oder als Einlage zinstragend anzulegen, und nach obigen Bestimmungen zu verwalten resp: den Ertrag an Hilfsbedürftige Mädchen in Sinne dieser Stiftungsurkunde zur Vertheilung zu bringen. Urkund dessen würde diese Stiftung-Urkunde in vier gleichlautende Exemplaren ausgefertigt, wovon je ein Exemplar dem Herrn Bürgermeister der königl. Freistadt Zombor, dem Herrn Vorsteher der israel. Cultus-Gmeinde zu Zombor, der Zomborer-Sparcassa-Actien-Gesellschaft und dem gefertigten Markus Stein ausgefolgt, die genanten zugleich Gebeten die Verwaltung dieser wohlthätigen Stiftung mit berücksichtigung des damit befolgten humanen Zwekkes übernehmen, und zum gedeihen dieser Stiftung ausüben zu wollen. Founding letter of the Johanna Stein Foundation for Marriage Assistance 213/1888 presidential Respected Ferencz Szlávy, city archivist It is invited that the Founding Letter of the Johanna Stein Foundation for Assistance in Marriage, which was with case number 1476 from 1875, be placed in an archive iron cabinet for safekeeping. Sombor, September 13th, 1888 Csihás Mayor Johanna /: Hanni :/ Stein’s Marriage Dowry Foundation Charter Marriage-Dowry-Foundation Charter It was the will of God Almighty to call the wife and mother of the undersigned, Johanna /: Hanni: / Stein, born Deutsch, much earlier than the law of nature usually does, into a better afterlife. The painful, sad, irreplaceable loss does not only affect our families, who mourn the best wife and mother, but also the poor in Sombor, whom she tried to alleviate their tragic state, lost a true benefactress, of which there can be one too many. In order to continue to preserve the memory of the blessed lady Johanna /: Hanni: / Stein, born Deutsch, to perpetuate the memory of this pious benefactress with a merciful foundation for future generations, and finally, in order to alleviate our pain over her passing to some extent through a merciful deed, the undersigned have decided to set up a foundation for eternity under the following conditions. I. Foundation name The foundation bears the name "Johanna /: Hanni: / Stein’s Marriage-Dowry-Foundation." II Foundation fund As a fund, the annual income of which is to be used for eternity under the following provisions for the purposes specified below, the undersigned deposit 2 /: two: / shares of Sombor-Savings bank-Joint-stock company No. 391 and 392 in nominal value at 200 fl. each, i.e. two hundred guldens in Austrian currency. III Purpose of the foundation a) This foundation is made with the express and unalterable dedication, which is derived from the deduction of the 2 Sombor-Savings bank shares described in point II, every 200 days two hundred guldens in Austrian currency for marriage dowry allowance in cash for the needy, morally well-mannered girls of the faith of Moses living in Sombor, under the following conditions. b) To a bride who has proven the conditions prescribed to obtain a marriage dowry allowance, can and may be awarded marriage dowry allowance of no less then 200 i.e. two hundred guldens in Austrian currency. c) Should the annual income of the above two shares amount to less than 200 florins, then this income, together with the octroi [type of tax] and compound interest granted to the Sombor-Savings bank, is to be invested and increased in a fructifying manner, until the marriage dowry allowance has reached, in the sense of this foundation, the required amount of two hundred guldens of Austrian currency. d) If, on the other hand, the annual income of the shares described in Point II is more than 200 guldens, as many as possible wedding dowry applicants who are entitled to claim a dowry allowance according to the steps contained in Point III a) are allowed to do so – if they are involved at the same time, – as long as the earnings of the foundation show an amount divisible by 200 florins, or as long as amounts of 200 florins for each of them are available. e) The article d) of the provision contained therein must also be applied in the event that an applicant is unable to report an already distributable amount of at least two hundred guldens, or one that doesn’t fully meets the conditions set out in this foundation deed, in which case the given respective yield is to be invested in a fructifying manner, and if so, according to the article d) the prescribed provisions can also be distributed to several qualified applicants. f) In case that an applicant has met those conditions to obtain the marriage dowry allowance stated in the sense of Point III. a), the said premium of 200 florins has to be handed over on the day after the wedding ceremony. IV Administration of the fund The administration of the Savings bank-Joint-stock company dedicated to this foundation respectively: its octroi and dividends and its coupons may be managed and profitably invested by the Sombor Savings bank as safekeeping of these stocks, and the coupons belonging to them, and as soon as the income of the shares reaches the amount of two hundred guldens or a larger amount divisible by two hundred guldens, the laudable management of the Sombor-Savings bank-Joint-stock company will notify the respective head of the Jewish community in Sombor about this, together with a report on the income resulting from the fund dedicated to the foundation. V Type of distribution of the income The right of judgment, as well as the right of instruction of the already available payment amounts - or in the sense of Point III. d) several amounts of two hundred guldens each that could be distributed to several equally qualified applicants - belongs to the respective mayor of the Free Royal City of Sombor, the respective head of the Jewish community in Sombor in association with the oldest male member of the family of Markus and Johanna /: Hanni: / Stein. The undersigned Markus Stein reserves the right of disposal, in association with the above-mentioned, over the payment amounts that are distributed during his life. VI a) The respective mayor of the Free Royal City of Zombor has the role of a chairman. b) Should there be a difference in the participation of the applicants, or for whatever reason and cause between the - in the sense of Point V for instruction regarding the handing over of the disbursement amount - authorized gentlemen, if there is a difference of opinion, the majority of the votes decides. VII Ancillary provisions If the Sombor-Savings bank-Joint-stock company should issue new shares in the future, on the grounds made to retain the subscription right, to which, for example, new shares issued after shares No. 391 and No. 392, expressly for themselves and their legal heirs, so that the new shares that may have to be committed will become the exclusive property of the founders or that of their heirs and legal successors, consequently also the payments to be made to them without encumbering the Foundation has to happen on its own. VIII The undersigned founders and their heirs also reserve the right to vote in the general assembly according to the statutes of the Sombor-Savings bank-Joint-stock company and according to the acts dedicated to this Foundation, with the remark that this should be exercised by the eldest male member of the family of Johanna /: Hanni: / and Markus Stein. IX In the event that the Sombor-Savings bank-Joint-stock company should ever dissolve, the Curatorium appointed to administer this foundation is obliged to invest the decree of these foundation acts in a similar institution that is as secure as possible, either in shares or as an interest-bearing deposit, and according to the above provisions to manage or to distribute the income to needy girls in the sense of this deed of foundation. Charter of this foundation will be made in four identical copies, one copy of which was given to the mayor of the Free Royal City of Sombor, the head of the Jewish community in Sombor, the Sombor-Savings bank-Joint-stock company and the undersigned Markus Stein, who heeded the aforementioned appeal to take over the administration of this charitable foundation, taking into account its humane purpose, and to guide this foundation to prosperity. Der Wille Gottes des allmächtigen war es, die Gattin, resp: Mütter der gefertigten, Johanna /: Hanni :/ Stein geboren Deutsch, zu unserem grüßten Schmerze, viel früher als es nach dem Gesetzt der Natur zu geschehen pflegt, in ein besseres Jenseits abzuberufen.

Der schmerzlich traurig unersetzlich Verlust berühet nicht blos unsere Familien allein, die wir in ihr die beste Gattin und Mütter beweinen, sondern auch die Armen in Zombor, denen sie ihr trauriges Loos Stats nach besten Dräften zu lindern bemüht war, verloren ihr eine wahre Wohlthäterin, deren es ein zu viele geben kann.

Um das andenken der seeligen frau Johanna /: Hanni :/ Stein geboren Deutsch auch fernerhin zu erhalten, um die Erinnerung an diese fromme Wohlthäterin durch ein milde Stiftung bei künftigen Generationen zu verewigen, um endlich unserem Schmerze über ihr hinscheiden durch eine milde That einigermaßen Linderung zu verschaften, haben die gefertigten beschlossen eine Stiftung unter nachfolgenden bedingungen für ewige Zeiten zu gründen.

Name der Stiftung

Die Stiftung führt den Namen „Johanna /: Hanni :/ Stein’sche Heirats-Asstattungs-Stiftungs.“

II
Fond der Stiftung

Als Fond, dessen jährliches Erträgniß für ewige Zeiten, unter den nachfolgenden Bestimmungen zu den unten bezeichenten Zwecke verwendet werden soll, wideren den gefertigten 2 /: zwei :/ Stück Actien der Zombor-Sparcassa-Actien-Gesellschaft No. 391 und 392 im Nominalwerthe am je 200 fl. sage zwei hundert Gulden in österr. Währg.

III
Zweck der Stiftung

a) Diese Stiftung geschieht mit der ausdrücklichen und unabänderlichen Widmung, das aus dem Erträgniße der in Punkta II beschriebenen 2 Stück Zombor-Sparcassa-Actien jedesmahl 200 tage Zwei Hundert Gulden in österr. Währg. an Heirats-Ausstatungs-Beihilfe an hilfsbedürftige, moralisch gut gesittete in Zombor wohnhafte Mädchen mosaischen Confession in baarem Gelde, unter folgenden Bedingungen ausgefolgt werden.

b) An eine Braut, welche die sub litt. zur Erlangung einer Heirats-Ausstattungs-Beihilfe vergeschriebenen Bedingungen nachgewiesen hat, können und dürfen ein mehr aber auch nicht weniger als 200 mit Worten Zwei Hundert Gulden in österr. Währg. – als Heirats-Ausstattungs-Beihilfe ausgefolgt werden.

c) Sollte den jährliche Ertrag der genannten zwei Stük Actien weniger als 200 fl. ausmachen, so ist dieser Ertrag sammt den jeweiligen den der Zomborer-Sparcass zu gewährenden Ziesen und Zinseszinsen insolangen fructificirend anzulegen und zu vermehren, bis er die im Sinne dieser Stiftung zu einer Heirats-Ausstattungs-Beihilfe nötige höhe von Twei Hundert Gulden österr. Währg. erreicht hat.

d) Beträgt hingegen der jährlich Ertrag den im Punkte II beschriebenen Actien mehr als 200 Gulden, so können auch so viele Heirats-Ausstattungs-Bewerberinen welche laut den im Punkte III litt a) enthaltenen Vorschritten einen Auspruch auf eine Ausstattungs-Beihilfe zu erheben berechtigt sind, - zu gleicher Zeit betheilt werden, - insolange das Erträgniß der Stiftung einen durch 200 fl. theilbaren Betraf ausweist, resp: insolange Beträge zu je 200 fl. verhanden sind.

e) Die in litt. d) enthalten Bestimmung hat auch in dem Falle in Anwendung zu kommen, wenn bei Vorhandensein eines bereits vertheilbaren Betrages von wenigstens Zwei Hundert Gulden eine Bewerberin sich nicht melden sollen, oder eine solche nicht, welche den in dieser Stiftungs-Urkunde festgesetzten Bedingungen vollkommen entspricht, in welchem Falle gennanter jewiligen Ertrag fructificirend anzulegen ist, und vorkommenden Falles nach den sub litt. d) vorgeschrieben Bestimmungen auch an mehrer qualificirte Bewerberinnen vertheilt werden kann.

f) Hat ein Bewerberin jene bedingungen nachgewiesen, welche im Sinne des Punktes III litt. a) zur erlangung der Heirats-Ausstattungs-Praemie vergeschrieben sind, so hat die Ausfolgung genannter Praemie von 200 fl. am Tage nach Rituell vollzogener Trauung erfolgen.

IV
Verwaltung des Fondes

Die Verwaltung der dieser Stiftung gewidmete Sparcassa-Actien resp: der nach dieser und deren Coupons entfallenden Ziesen und Dividenden möge die Zomborer Sparcassa als Bewahrin dieser Actien, und der zu denselben gehörigen Coupons leiten und fruchtbringend anlegen, und sobald der Ertrag der Actien die höhe von Zwei Hundert Gulden oder einen durch Zwei Hundert Gulden theilbaren großeren Betrag erreicht haben wird, wollen die löbl. Direction der Zomborer Sparcassa-Actien-Gesselschaft dies nebst einen Bericht über den aus dem der Stiftung gewidmete Fonde sich ergebenen Ertrag, dem jewiligen Vorsteher der isr. Cultus-Gemeinde zu Zombor alsogleich anzeigen.

Art der Vertheilung des Erträgnisses

Das Zuurtheilungsrecht, sowie das Recht der Anweisung der bereits verfügbaren Ausspattungs-beträge, an eine, - oder wenn in Sinne des Punktes III litt. d) mehrere Beträge zu je Zwei Hundert Gulden zur Vertheilung gelangene sollten – an mehrere gleichmäßig qualificirte Bewerberinnen, haben der jeweilige Bürgermeister der königl. Freistadt Zombor, der jeweilige Vorsteher der israel. Cultus-Gemeinde zu Zombor im Vereine mit dem ältesten großjährige männlichen Mitgliede der Familie nach Markus und Johanna /: Hanni :/ Stein auszuüben.

Der gefertigte Markus Stein behält sich über die während seines Lebens zur Vertheilung gelangenden Ausspattungsbeträge, das Verfügungsrecht im Verein mit den abgenannten vor.

VI

a) Bei den diesfälligen Berathungenhat der jeweilige Bürgermeister der königl. Freistadt Zombor den Vorsitz zu führen.

b) Sollte sich bezüglich der betheilung der Bewerberinnen, oder aus was immer für einem Grunde und anlasse zwischen den – im Sinne des Punktes V zur Anweisung resp. Ausfolgung des Ausspattungsbetrages – berechtigten Herren, eine Meinungsverschiedenheit ergeben, so entscheidet die Mehrheit der Stimmen.

Nebenbestimmungen

Falls die Zomborer-Sparcassa-Actien-Gesellschaft in der Zukunft neue Actien emittiren sollte, so behalten die gefertigten Gründen das Bezugsrecht, auf die etwa nach den Actien No. 391 und No. 392 entfallenden neuen Actien, ausdrücklich für sich und ihre gesetzlichen Erben bevor, so daß die eventuell zu begiehenden neuen Actien das ausschließlich Eigentum der Gründer resp: das ihrer Erben und Rechtsnachfolger bilden wird, in folge dessen auch die auf diese zu beistenden Einzahlungen ohne Belastung der Stiftung aus eigenem zu geschehen hat.

VIII

Die gefertigten Gründer behalten sich ferner und ihren Erben, das ihnen lauf Statuten der Zomborer-Sparcassa-Actien-Gesellschaft nach den dieser Stiftung gewidmete Actien zukommende Stimmrecht in der Generalversammlung mit dem Bemerken vor, daß dies auszuüben das älteste großjährige, männliche Mitglied der Familie nach Johanna /: Hanni :/ und Markus stein berechtigt ist.

Im Falle die Zomborer-Sparcassa-Actien-Gesellschaft sich jemals auflösen sollte, so ist das zur Verwaltung dieser Stiftung bestellte Curatorium verpflichtet den erläs dieser Stiftungs-Actien in einem ähnlichen möglichst sichern Institite entweder in Actien oder als Einlage zinstragend anzulegen, und nach obigen Bestimmungen zu verwalten resp: den Ertrag an Hilfsbedürftige Mädchen in Sinne dieser Stiftungsurkunde zur Vertheilung zu bringen.

Urkund dessen würde diese Stiftung-Urkunde in vier gleichlautende Exemplaren ausgefertigt, wovon je ein Exemplar dem Herrn Bürgermeister der königl. Freistadt Zombor, dem Herrn Vorsteher der israel. Cultus-Gmeinde zu Zombor, der Zomborer-Sparcassa-Actien-Gesellschaft und dem gefertigten Markus Stein ausgefolgt, die genanten zugleich Gebeten die Verwaltung dieser wohlthätigen Stiftung mit berücksichtigung des damit befolgten humanen Zwekkes übernehmen, und zum gedeihen dieser Stiftung ausüben zu wollen.

It was the will of God Almighty to call the wife and mother of the undersigned, Johanna /: Hanni: / Stein, born Deutsch, much earlier than the law of nature usually does, into a better afterlife.

The painful, sad, irreplaceable loss does not only affect our families, who mourn the best wife and mother, but also the poor in Sombor, whom she tried to alleviate their tragic state, lost a true benefactress, of which there can be one too many.

In order to continue to preserve the memory of the blessed lady Johanna /: Hanni: / Stein, born Deutsch, to perpetuate the memory of this pious benefactress with a merciful foundation for future generations, and finally, in order to alleviate our pain over her passing to some extent through a merciful deed, the undersigned have decided to set up a foundation for eternity under the following conditions.

I.
Foundation name

The foundation bears the name "Johanna /: Hanni: / Stein’s Marriage-Dowry-Foundation."

II
Foundation fund

As a fund, the annual income of which is to be used for eternity under the following provisions for the purposes specified below, the undersigned deposit 2 /: two: / shares of Sombor-Savings bank-Joint-stock company No. 391 and 392 in nominal value at 200 fl. each, i.e. two hundred guldens in Austrian currency.

III
Purpose of the foundation

a) This foundation is made with the express and unalterable dedication, which is derived from the deduction of the 2 Sombor-Savings bank shares described in point II, every 200 days two hundred guldens in Austrian currency for marriage dowry allowance in cash for the needy, morally well-mannered girls of the faith of Moses living in Sombor, under the following conditions.

b) To a bride who has proven the conditions prescribed to obtain a marriage dowry allowance, can and may be awarded marriage dowry allowance of no less then 200 i.e. two hundred guldens in Austrian currency.

c) Should the annual income of the above two shares amount to less than 200 florins, then this income, together with the octroi [type of tax] and compound interest granted to the Sombor-Savings bank, is to be invested and increased in a fructifying manner, until the marriage dowry allowance has reached, in the sense of this foundation, the required amount of two hundred guldens of Austrian currency.

d) If, on the other hand, the annual income of the shares described in Point II is more than 200 guldens, as many as possible wedding dowry applicants who are entitled to claim a dowry allowance according to the steps contained in Point III a) are allowed to do so – if they are involved at the same time, – as long as the earnings of the foundation show an amount divisible by 200 florins, or as long as amounts of 200 florins for each of them are available.

e) The article d) of the provision contained therein must also be applied in the event that an applicant is unable to report an already distributable amount of at least two hundred guldens, or one that doesn’t fully meets the conditions set out in this foundation deed, in which case the given respective yield is to be invested in a fructifying manner, and if so, according to the article d) the prescribed provisions can also be distributed to several qualified applicants.

f) In case that an applicant has met those conditions to obtain the marriage dowry allowance stated in the sense of Point III. a), the said premium of 200 florins has to be handed over on the day after the wedding ceremony.

IV
Administration of the fund

The administration of the Savings bank-Joint-stock company dedicated to this foundation respectively: its octroi and dividends and its coupons may be managed and profitably invested by the Sombor Savings bank as safekeeping of these stocks, and the coupons belonging to them, and as soon as the income of the shares reaches the amount of two hundred guldens or a larger amount divisible by two hundred guldens, the laudable management of the Sombor-Savings bank-Joint-stock company will notify the respective head of the Jewish community in Sombor about this, together with a report on the income resulting from the fund dedicated to the foundation.

V
Type of distribution of the income

The right of judgment, as well as the right of instruction of the already available payment amounts - or in the sense of Point III. d) several amounts of two hundred guldens each that could be distributed to several equally qualified applicants - belongs to the respective mayor of the Free Royal City of Sombor, the respective head of the Jewish community in Sombor in association with the oldest male member of the family of Markus and Johanna /: Hanni: / Stein.

The undersigned Markus Stein reserves the right of disposal, in association with the above-mentioned, over the payment amounts that are distributed during his life.

VI

a) The respective mayor of the Free Royal City of Zombor has the role of a chairman.

b) Should there be a difference in the participation of the applicants, or for whatever reason and cause between the - in the sense of Point V for instruction regarding the handing over of the disbursement amount - authorized gentlemen, if there is a difference of opinion, the majority of the votes decides.

VII
Ancillary provisions

If the Sombor-Savings bank-Joint-stock company should issue new shares in the future, on the grounds made to retain the subscription right, to which, for example, new shares issued after shares No. 391 and No. 392, expressly for themselves and their legal heirs, so that the new shares that may have to be committed will become the exclusive property of the founders or that of their heirs and legal successors, consequently also the payments to be made to them without encumbering the Foundation has to happen on its own.

VIII

The undersigned founders and their heirs also reserve the right to vote in the general assembly according to the statutes of the Sombor-Savings bank-Joint-stock company and according to the acts dedicated to this Foundation, with the remark that this should be exercised by the eldest male member of the family of Johanna /: Hanni: / and Markus Stein.

IX

In the event that the Sombor-Savings bank-Joint-stock company should ever dissolve, the Curatorium appointed to administer this foundation is obliged to invest the decree of these foundation acts in a similar institution that is as secure as possible, either in shares or as an interest-bearing deposit, and according to the above provisions to manage or to distribute the income to needy girls in the sense of this deed of foundation.

Charter of this foundation will be made in four identical copies, one copy of which was given to the mayor of the Free Royal City of Sombor, the head of the Jewish community in Sombor, the Sombor-Savings bank-Joint-stock company and the undersigned Markus Stein, who heeded the aforementioned appeal to take over the administration of this charitable foundation, taking into account its humane purpose, and to guide this foundation to prosperity.
